Terms of Service
When you download or install the App, you need to read and agree to the terms of this Agreement. Please read and understand all the rights and restrictions set forth in this Agreement. If you do not agree to all of these provisions of this Agreement, you are not authorized to download, install or use our App and related services. Once you install, copy, download, access or use our App in any other way, you will be deemed to have accepted this Agreement and agree to be bound by the above terms. If you do not fully agree to the terms set forth in this Agreement, please do not install, copy or use our App.
Statement that all of our intellectual property and related information may include, but are not limited to, written expressions and their combinations, icons, graphic designs, images, charts, color schemes, interface designs, layout frameworks, related data, additional applications, printed materials and electronic documents, all of which belong to us and are protected by copyright laws, international copyright treaties and other intellectual property protection laws and regulations.
You declare and warrant that you are 13 years of age or older. If you are under 13 years of age, you may not use our products. You are solely responsible for ensuring that these Terms of Service comply with all laws, rules and regulations applicable to you. In addition, the Products are for your use only and may not be used or benefited by any third party.
Our company shall own all right, title and interest in the Technology and Services, including all associated intellectual property rights. This Agreement is not a sale and does not transfer to you any ownership or rights in or to the Technology or Services, or any intellectual property owned by our company. The company or product names, logos, and product names associated with the Technology and Services are trademarks of our company or third parties, and no right or license to use them is granted. You agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary notices incorporated in or accompanying the Technology or Services.
You expressly understand and agree that your use of the Technology and Services is entirely at your own risk. We periodically make changes to the Technology and Services and may do so at any time without notice. We will make reasonable efforts to ensure that the Technology and Services are available as much as possible, but do not guarantee that they will always be available. The Technology and Services are provided "as is" without any express or implied warranties, guarantees or conditions, including but not limited to warranties, guarantees or conditions of merchantability, fitness for a particular or general purpose, and non-infringement. We make no warranties, conditions or representations about the accuracy, reliability, completeness or timeliness of the content provided through the Technology or the Services or the Services, technology, text, graphics or links.
You hereby grant us an irrevocable, perpetual, transferable, fully paid, royalty-free, worldwide license (including the right to sublicense and assign to third parties) and the right to copy, reproduce, repair, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform or provide access to broadcast electronically. Except as prohibited by law, you waive any right of attribution or any moral rights in your User Content, regardless of whether your User Content is altered or modified in any way. We do not claim any ownership rights in your User Content, and nothing in these Terms of Service is intended to restrict any rights you have to use and exploit your User Content. We have no obligation to monitor or enforce your intellectual property rights in your User Content.
We reserve the right to modify or replace any of these Terms of Service, or to change, suspend or discontinue the Products (including, without limitation, the availability of any features, databases or content), at any time in our sole discretion. We may post notices on the Site or send you notices through the Products by email or other appropriate electronic communication methods. We may also impose limits on certain features and services, or restrict your access to parts or all of the Products, without notice or liability. Although we will promptly provide notice of modifications, it is also your responsibility to check these Terms of Service periodically for changes. Your continued use of the Products following notice of any changes to these Terms of Service will constitute your acceptance of those changes, and those changes will apply to your continued use of the Products going forward. Your use of the Products is subject to the Terms of Service in effect at the time of your use.
